The Civil Litigation and the Origins of the Lawsuits

Manufacturers have an obligation to inform the public about any harmful effects of the products they create and market. When a manufacturer fails to provide adequate warnings about the risks related to the use of a particular product, it could be held liable in lawsuits for injuries and damages that may result.

Companies did not warn about the dangers of cow’s milk-based formula for premature infants.

If premature infants are fed cow's milk-based milk products, they can develop necrotizing enterocolitis (NEC), a serious gastrointestinal condition that mostly affects premature babies resulting in inflammation and death of intestinal tissue.

Lawsuits

With a wave of injuries associated with infant formula, attorneys begin to file product liability and personal injury lawsuits on behalf of a growing number of victims – as the victims became aware of what had occurred, who was responsible and why along with their legal options, many were quick to jump on board. As the number of law suits grew, so did the media coverage, and in turn the more media cover, the more awareness. This circle of media/awareness/and lawsuits not only increases the size of the litigation, but the amount of evidence that comes to light of corporate maleficence and wrong doing. As attorneys begin to from consortiums and plaintiff "discovery" committees – it is become painfully clear that Abbott Laboratories and Y, the manufacturers of Similac and Enfatize failed to include any warning on its product labeling and failed to provide physicians with guidance on the risk of NEC which prevented doctors from determining whether a safer alternative should be used.

Not only has Abbott failed to include any type of warning on the product labeling for Similac, but they have also actively promoted Similac as a safe alternative to breast milk and mislead doctors and consumers.
